DPP Keriako Tobiko says his office does not take instructions from anyone.
“The DPP wishes to make it clear that under Article 157 of the Constitution, his Office is independent and not subject to the directions, control or supervision of any person. At any rate, his office does not act on ultimatums issued at political rallies or barazas,” he affirmed.
Odinga had reportedly accused the military of scheming with the Independent Electoral and Boundaries Commission (IEBC) to rob him of the presidency during tallying of votes after the General Election last year.
Tobiko has however asked those who may be aggrieved to file a complaint, either with the police or his office and the same shall be acted upon in accordance with the law.
“The DPP wishes to state that other than what he has read in the media about the alleged utterances and ultimatum issued by the politicians in question, his office has not received any formal complaint on the matter,” he said in a statement on Tuesday.
The IEBC as well as the National Security Advisory Committee has since asked the former Prime Minister to apologise for the alleged remarks.
Odinga was quoted in the media making the remarks in Kisumu on January 19 while speaking in his native Luo language.
The chairman of the National Security Advisory Committee Francis Kimemia accused Odinga of making false allegations because the military was never used in any of the polling or tallying centers.
According to Kimemia, the only role that the military played at the time was to secure the country’s borders.
“As the Chair of the Assumption to the office of the President Committee which oversaw the transition process also, we would like to ask the former Prime Minister to desist from inciting Kenyans through his creative and inflammatory and false allegations,” said Kimemia.
“We also urge Odinga to desist from inciting Kenyans over his democratic loss and disillusionment.”
Expressing its dismay, the IEBC stated, “This is a creative incitement and an extremely partisan posture that deliberately overlooks facts in order to continuously project the conduct of the 2013 general elections in negative light.”
“We challenge Raila Odinga to substantiate his claim or withdraw and apologise. Although elections are about politics, it is dangerous to politicize them.”
