NAIROBI Kenya, Oct 24 -The East Africa Law Society has faulted the Judicial Service Commission (JSC) for handling the Gladys Boss Shollei debacle ‘unprofessionally’.

The society Chairman James Mwamu said on Thursday that the matter – which saw Shollei sacked as Chief Registrar of the Judiciary – should have been handled in a sober manner to avoid watering down the Judiciary’s credibility.

Mwamu said the public may lose its confidence with the Judiciary despite the many reforms which have taken place so far.

“The JSC has not handled this matter in a professional way… this matter could have ended a long time ago,” he noted.
Shollei was sacked on October 18 after a protracted public battle between her and the JSC over allegations of impropriety.

While announcing her dismissal, Chief Justice Willy Mutunga said a verdict had been reached by the Judicial Service Commission to remove her from office after two months of investigations into allegations of financial misdeeds.

“It is the unanimous decision of the commission that the Chief Registrar of Judiciary is hereby removed from office with immediate effect,” he stated.

Shollei has since disputed the claims saying her sacking was premeditated by the JSC members. She also said the sacking was unprocedural claiming she was never given a chance to defend herself.

“The information in the media that I appeared before the commission and defended myself is not true. We never reached that stage because I raised various procedural matters,” she told a news conference on Monday.

She accused the JSC of open bias, “because within two hours the commission had a long statement ready for the media about my dismissal.”

Mwamu has at the same time cautioned Parliament to deal with a petition filed by a citizen to have the current JSC disbanded in a professional manner.

“The issue of disbanding JSC should be treated cautiously because disbanding it means removing the commission from the Constitution; that is not possible,” he said.
“Removing those commissioners at this time is not necessary.”
