Justice Roselyn Wendoh declared the election of Tunai as free and fair while dismissing allegations of irregularities raised by petitioner Ledama ole Kina.
In her ruling, Wendoh also dismissed allegations of voter’s bribery and bias by Independent Electoral and Boundaries Commission (IEBC) officials.
She pointed out that there was no evidence submitted by ole Kina to support his claims.
Wendoh also ruled that the errors and irregularities alleged by the petitioner did not affect the electoral process and the final results declared by IEBC.
A vote recount by the court for Narok West and Kilgoris showed there was no substantial difference of votes as Tunai garnered 87,832 votes while ole kina had 3,984 votes.
Ole Kina had moved to court to challenge the election of Tunai, saying the election was a complete sham and should not be allowed to stand.
During the ruling, the court dismissed allegations that some polling stations registered over 100 percent turnout.
Allegations by ole Kina that his agents were harassed and barred from accessing polling stations was also dismissed by the court.
Wendoh ruled that the petitioner despite alleging he had 1,300 agents, failed to show the court specific polling station where his agents were denied entry and harassed by IEBC officials.
The court also ruled out that the petitioner should pay Sh4.5 million as costs.
