KIE boss under probe over ‘malpractices’

OTIENDE-AMOLONAIROBI, Kenya Aug 23 – The Commission on Administrative Justice (Ombudsman) is investigating the Director of Kenya Institute of Education (KIE) Lydia Nzomo for abuse of office, misappropriation of funds and employing her kin without following due process.

A preliminary report compiled by the commission said Nzomo is also being probed for misusing funds in the institute’s reserve accounts.

In an investigation undertaken between April and August this year, Nzomo was cleared of five out of nine of the allegations with the remaining four pending further scrutiny.

Investigations were conducted through interviews with staff members from the institution, service providers and relevant government officials.

Nzomo was accused after an anonymous complaint was written by a “concerned KIE members of staff” which raised the allegations against the director.

The investigations revealed that Nzomo unprocedurally recruited two of her siblings Mercy Kaembe Mwangi and Charles Anampiu into the institution without due regard to the provisions relating to conflict of interest in recruitment within the public service.

In the report, it was discovered that KIE ran various Fixed Deposit Accounts besides other normal accounts which raised suspicion and created confusion in the tracking and monitoring of funds.

Nzomo is also allegedly accused for failing to follow legal procedure as she oversaw the opening of fixed deposit accounts with various commercial banks without the council’s authority.

Also accused is Charles Anampiu, Nzomo’s brother.

Anampiu is charged with conspiracy as he provided false information and misleading the commission’s investigators.

In its recommendations the commission asked both Anampiu and Mwangi be retired on public interest as their recruitment was marred with irregularities.

The commission also asked for review of the process for recruitment of staff members into by KIE now Kenya Institute of Curriculum Development (KICD).

The commission further added that the Office of the Auditor General needs to undertake and audit of all accounts held by KIE to ascertain that there was no mismanagement of public funds.

Nzomo and Anampiu are scheduled to appear before a panel of investigators and commission officials for a chance to defend herself before the commission makes a final decision.

The commission has recently come out to defend Chief Registrar of the Judiciary Gladys Shollei saying the Judicial Service commission was unfair in suspending her.

The commission is mandated to address all forms of maladministration, promote good governance and efficient public service delivery by enforcing the right to fair administrative action. We investigate abuse of power, manifest injustice and unlawful, oppressive, unfair or unresponsive official conduct.
