The prosecution has on several occasions raised concerns over intimidation and threats to victims and witnesses.
When ICC Prosecutor Fatou Bensouda dropped charges against former Head of Civil Service Francis Muthaura, she explained that there was not enough evidence due to harassment of witnesses and even alleged that some of them had been killed.
However she was tasked to provide evidence or use the provision under that Rome Statute that empowers her office to issue warrant of arrest when an accused person interferes with the ICC process especially intimidation of witnesses.
