NAIROBI, Kenya, Mar 1 – The Law Society of Kenya (LSK) has expressed confidence that the Judiciary is capable of handling petitions that may emanate from the General Election being held on Monday.

Speaking to Capital FM News, LSK council member and Kituo cha Sheria Acting Executive Director Gertrude Angote praised the Judiciary for putting in place mechanisms to speedily resolve election petitions.

“We believe the Kenyan Judiciary is ready, we have seen the progress. At least the backlog of the cases that we have seen in the past has been issued a blow. We have an increased number of judges,” she said.

“We now have a court that is friendly to the Kenyan public and therefore any Kenyan person would want to approach the court in case of any violation.”

Angote however added that the courts need to give better direction in the interpretation of Chapter Six of the Constitution which addresses the conduct and financial probity of state officers.

“You cannot see a particular philosophical thread running through the decisions that are being made by the courts… you look at a case like the Mumo Matemu case where the court gave a limited interpretation but it showed to a large extent that the court was really laying parameters that would play for personal integrity and the requirements therein.”

“There has been contrary decision to that if you look recently at the Uhuru, Ruto case where the court said look, we do not have jurisdiction.”

At the end of the day however, Angote says, the buck stops with the Kenyan populace which can put an end to corruption by voting in leaders with integrity and not allowing themselves to be swayed through bribes.

“The Kenyan people are at the centre of ensuring that every leader in office in this country meets the test of integrity. How will they do that? It is only but two days away. It is through the power of their vote.”

“If we get into office persons who are of questionable morality, persons who are of questionable character, persons who are selfish, persons who are partial, we’ll have no choice but to live with it.”

Angote also called on Kenyans to elect leaders who will ensure the full implementation of the Constitution, “It would be very wise to always make the Constitution of Kenya second to the Bible.”

“It is extremely progressive. It puts the Kenyan mwananchi, Wanjiku, at the centre. Kenyans are the ones who vote persons to Parliament to represent them.”
