NAIROBI, Kenya, Mar 13 – The Meru Council of Elders has welcomed the decision by the International Criminal Court prosecutor to drop all charges against former Head of Civil Service Francis Muthaura.

Speaking to Capital FM News, Njuri Ncheke chairman Paul M’thingithia said they and other Kenyans have all along believed Muthaura was innocent and did not play any role in the 2008 post-election violence.

“We have been praying for Muthaura and even for that court so that it can know the truth and release all the Kenyans it is investigating. We know they are innocent and the court will soon find out this,” M’thingithia asserted.

Though he regretted the violence that led to deaths of over 1,000 Kenyans, he said the court made an error to pick on Muthaura, President-elect Uhuru Kenyatta, his deputy William Ruto and former radio journalist Joshua arap Sang.

He said what Kenya needs and is already going through is a healing and reconciliation process, which according to him was demonstrated in the peaceful March 4 elections.

He said it could not have been the four who led to the violence.

According to M’thingithia, Kenyans would not have elected Kenyatta and Ruto if at all they are warlords.

“We Kenyans elected the two leaders on Monday and they won in this election. We could not have elected them if we think they are behind the post-election violence; ICC should know that the four are all clean,” he said.

“We are saying just like the way God has guided the ICC to find Muthaura’s innocence, let those judges also see the innocence of the other three,” he asserted.

Meru Senator-elect Kiraitu Murungi also welcomed the decision by ICC Prosecutor Fatou Bensouda to drop Muthaura’s case.

He echoed the elders’ stand that the rest of the accused should also have their charges dropped.

“This withdrawal confirms our suspicion that this was a political case that could not stand any serious legal scrutiny. It is now obvious that the prosecution has no choice but to accept the inevitable and also withdraw unconditionally the charges against Kenyatta, Ruto and Sang,” he said.

The ICC Prosecutor at Monday’s Status conference filed a motion seeking to have all charges against Muthaura dropped.

She said the prosecution had dropped Witness No 4’s evidence that led to the confirmation of charges against Muthaura.

However she said the decision would not apply to the other accused persons.

Presiding Judge Kuniko Ozaki however informed her that the decision would definitely have an impact on the case against Kenyatta, who was jointly accused with Muthaura.
