State prosecutor Lillian Obuo urged a magistrate’s court to ask Waititu to desist making comments on the case in public forums saying they may be contemptuous.
Obuo told the trial court that Waititu who is in the Nairobi’s gubernatorial race discussed at length the case before the court during a recent interview on television station.
“The accused should be warned not to make such comments that are tantamount to integrity, independence of court and fair trial that we seek to administer. It appeared he was giving evidence at length knowing well that the case is before court.”
But Waititu through lawyers Cliff Ombetta and Evans Ondieki said the State cannot just make allegations without adducing evidence.
“When such an allegation is made, they must show what words were used and show to what extent they were contemptuous. They ought to bring the clip so that he can defend himself,” the advocates argued.
The politician was in court for the hearing of case in which he is facing incitement to violence and hate speech charges.
The hearing continues.
