NAIROBI, Kenya Jan 14 – The Law Society of Kenya says it has recommended to the Chief Justice that Immigration Minister Otieno Kajwang be reinstated back to the Roll of Advocates after he cleared all the complaints levelled against him.

LSK Chief Executive Apollo Mboya said Kajwang reinstatement was on condition that he would for 24 months practice law under supervision of an Advocate of the High Court of at least 35 years standing.

He said the Disciplinary Committee made a recommendation to Chief Justice Willy Mutunga for Kajwang’ to be restored to the Roll of Advocates subject to set conditions.

“The Law Society of Kenya Disciplinary Committee cleared him. According to Section 71 0f The Advocates Act what is now remaining is for the Chief Justice to order the Registrar to restore his name on The Roll of Advocates,” LSK says in a statement.

The CJ will upon the recommendation of the Tribunal direct restoration of struck off advocates after payment of a prescribed fee.

During the first 12 months after his reinstatement, Kajwang’ will be required to make a minimum of five presentations during LSK’s compulsory Continuing Legal Education (CLE) seminars.

“The presentations will be on topics he has expertise in under supervision of the Committee on CLE,” Mboya said in a statement released on Monday.

He said LSK would forward the orders of the Disciplinary Committee to the Chief Justice for action after members of the Committee have signed.

“The process of reinstatement of an Advocate of the High Court of Kenya to the Roll of Advocates is provided under the Advocates Act. According to the Section 71 of the Act, The Chief Justice has powers to order the Registrar to restore on the Roll the name of any advocate,” he added.

The LSK boss was responding to questions raised by Ekuru, Kabage, Nyamathwe and Co Advocates on the Minister’s suitability to contest for public office considering he was struck off the Roll of Advocates.
