Mwakwere wants to block the NCIC, police and the Director of Public Prosecutions from filing charges against him/FILE

NAIROBI, Kenya, Aug 30 – The High Court has temporarily blocked the prosecution of Cabinet Minister Chirau Ali Mwakwere until Monday over hate speech charges.

Justice David Majanja has given Mwakwere the provisional reprieve until then, when he will decide whether to extend prohibitory orders to enable him argue the case contesting the charges.

The Environment Minister wants to block the National Cohesion and Integration Commission, the police and the Director of Public Prosecutions from filing charges against him.

The Matuga MP is alleged to have made the speech during a by-election campaign in his constituency in July 2010, to the effect that indigenous Coastal people have been oppressed by Arabs.

The Environment Minister had moved to court in a bid to block a chief inspector of police Robert Mabera, Commissioner of Police, NCIC, the Attorney General and DPP from arresting and prosecuting him.

In the application, Mwakwere states that in the speech, he was airing his views on the historical injustices suffered by his people, which is a constitutional right guaranteed to him under Article 27 of the Constitution.
