The controversy heightened when Kimunya cancelled the tender claiming that it could lead to loss of public money/FILE
NAIROBI, Kenya, Aug 30 – The Kenya Airports Authority (KAA) Board – has now threatened to move to court next week over the award of a Sh55 billion tender to a Chinese firm for the construction of a second airport terminal at the Jomo Kenyatta International Airport.
This follows a ruling by the Public Procurement Oversight Authority (PPOA) which ordered Kenya Airports Authority to reinstate the tender to the Chinese firm after it was controversially cancelled.
The KAA Board chairman Martin Wambora said the matter may now have to be handled by the courts, saying it was illegal for authority to force them to award the tender which was contested.
The PPOA on Wednesday ordered the lifting of the earlier cancellation of the tender by – Transport Minister Amos Kimunya and ordered KAA to execute the Greenfield Terminal tender to Anhui Construction Engineering Group of China within the next 30 days.
Speaking to Capital FM News on Thursday morning, Wambora however said KAA will not award the tender until the matter is cleared by the courts.
“It would be against the law for anyone to push us to give such a huge tender in a very unclear process. Remember this is public funds. We cannot just wake up and give the tender to only one person. We must do redesigning of this tender. What is the hurry for?” Wambora posed.
The PPOA – ruled that Kimunya had no basis in law to order the Kenya Airports Authority to cancel the award of the tender.
