Miguna now under probe over poll violence claims

The DPP says Miguna is obligated to make a statement to the police on what he knows/FILE

NAIROBI, Kenya, Jul 16 – The Director of Public Prosecutions Keriako Tobiko on Monday directed the police commissioner to open investigations into allegations made by Miguna Miguna over the 2008 post-election violence.

Tobiko further indicated that Miguna could faces charges if it’s established that he withheld crucial information about those behind the deadly violence.

He said the law requires the former advisor to Prime Minister Raila Odinga or any other Kenyan with evidence on a crime to record a statement immediately with the police.

“There is an offence in our law called accessory after the facts. Miguna Miguna exposes himself potentially to charges of being an accessory after the facts,” he asserted.

According to the DPP, Miguna is obligated to record a statement with the police if he has evidence on the post-election violence as he alleges.

He said his office was looking at the allegations made by Miguna and will in due course make a response on the action to be taken.

Miguna on Saturday launched his sensational book ‘Peeling Back the Mask’ and has given wide ranging interviews in which he has made grave allegations against the PM and his close associates.

“Soon after I get the full texts of what he is alleged to have said, I will be able to issue appropriate directives to the commissioner of police,” the DPP said.

Tobiko expressed concerns that it took Miguna four years to disclose evidence concerning the violence that followed the disputed presidential election of 2007.

“If he has evidence to implicate any person, he has an obligation in law to report to the police. It is his duty. In fact, the law requires every Kenyan who has evidence (to disclose it).

Miguna has claimed that he has incriminating evidence against top government officials on their role during the violence.

During the launch of his book on Saturday, he said: “Every single leader here, I can take to The Hague. I have it right here. And I am saying come baby come… when I decide in a 500-page book not to say what the Orange Democratic Movement did in the PEV, they should take me, kneel before me and kiss my feet. That is how angry I am when I see some people running around like idiots.”

Earlier, Imenti Central MP Gitobu Imanyara asked the office of the DPP to investigate Miguna over his claims about PEV which he has vowed to disclose in his next publication.

Two days after daring those angered by his publication to move to court, Odinga’s Chief of Staff Caroli Omondi became the first to ask his lawyers to take legal action against Miguna, publishers of his book and the Nation Media Group which has been publishing excerpts of his book.

    With all due respect to the DPP , you are now sinking to the level of “A POLITICAL TAUT”. Pray- in which forum were Kenyans called upon to “give evidence regarding PEV that Miguna failed to turn up”? How many people my family included who lost all in PEV and have lived in camps since have “evidence regarding who burned our village and who was the beneficiary” have you asked them for evidence? Did you watch on national television beamed live to Kenyans and around the world via internet a person who is alive and busy-nay prominent in politics today declare at KICC : IF THE RESULTS ARE DECLARED/READ AS THEY ARE KENYA WILL BURN? and soon after we saw smoke live on television? Have you ever talked to that fellow? Might you want to meet him before you seek one Miguna Miguna? I have no interest in what MM is talking about-anyone who jokes about the atrocities my family has endured is a dangerous person.But so is any official who wants to engage in nonsense.

    Director of Public Prosecutions has always been my favorite man. However, his latest action points to a serious betrayal. First, he didnt have to receive instrustions from Odm minister, in this case the accused! Secondly, state security agencies should be in full swing cross-checking Miguna’s allegations. All those mentioned must give their side of the story, no matter how powerful. Kenyans have found themselves on the wrong side of history because they are patently intent on pursuing whats not and ignoring the truth.
    DPP must be independent and seen to be so. Attempting to criminalize potentially serious information that casts doubts on integrity of seemingly ever pretentious candidate is in itself criminal. The country needs to be set free from tenacious jaws of corruption and deceitful merchants. Thats the only way for this country to take off.

    Miguna’s claims are utter nonsense. His intention is to relate characters in ODM to the drama’s in 1980. He wants to relate Orengos spendings on cloth to Njonjos imported suites.He intimated this on K24 show with Jeff.How does orengos personal expenses become a national issue.He claims Mutula was a crammer in law school. I don’t think he was ever mutulas classmate.He attacks Ngilu, Aida , Midiwo and Oburu and anybody else he perceives to be enemy.He claims RAO wanted Ruto and Uhuru locked in hague. How can that be when RAO has been persuading his fores to accept local tribunal all along.He contracts himself by claiming RAO cannot intervene in Hague process because it is an independent court.He attempts to weaken RAO’s relation with Kikuyus’s just because he knows that is his lowest political ebb.The fellow is already scared and in a tongue twisting mode when he learns Tobiko wants him investigated.His pride cannot allow him to go to Nairobi law school yet he claims to teach experts some law in kenyan courts.He must be a big baby
