NAIROBI, Kenya, Apr 20 – The Director of Public Prosecutions has ordered police to arrest and charge Gem MP Jakoyo Midiwo for giving false information that there was a plot to kill Prime Minister Raila Odinga.

Tobiko says he has given the nod to police after perusing the investigation file and was satisfied that there was sufficient evidence to arraign the legislator in court.

“I have perused the investigation file with recommendation that the legislator be charged for giving false information and I am satisfied that there was sufficient evidence to charge him,” the DPP said.

“I have directed the Police Commissioner to immediately arrest and charge him in court.”

Midiwo sensationally made the claims at a burial in Bondo about 10 days ago where he also mentioned Foreign Affairs Minister Prof Sam Ongeri as being part of the scheme.

The probe was initiated following a directive issued to Police Commissioner Mathew Iteere by the Director of Public Prosecutions on Monday last week.

The lawmaker who is a joint government chief whip recorded a statement with the Criminal Investigations Department the following day at their Mazingira headquarters.

He emerged from the interrogation session and said he stood by the statement he made in Bondo.

“Yes, I stand by that statement; however I am not going to discuss those details with you. I have told the police all they needed to know,” he told the media at the time adding, “the life of any citizen including the Prime Minister cannot be taken lightly. This is a serious matter!”

On Wednesday of the same week, Foreign Affairs Minister Sam Ongeri wrote to Midiwo demanding an apology for defamation, after linking him to the assassination plot.

Through Nyaberi and Company Advocates, Ongeri wanted Midiwo to apologise within seven days or face legal action.

“We are instructed to demand from you that you forthwith retract your allegations,” the demand letter dated April 11 stated.

Midiwo was told that the apology must be presented to Ongeri, published in local newspapers and broadcast in television stations that carried the defamatory remarks.

Midiwo sensationally alleged a plot to assassinate the PM, saying that mercenaries had been hired to execute the plot.

He spoke in the presence of the Prime Minister and Cabinet ministers Anyang’ Nyong’o, Dalmas Otieno and James Orengo during a funeral in Bondo District.

Midiwo did not disclose the nationalities of people who were to be involved in the plan.

    All kenyans despite their position in community should learn to be civil and avoid creating situations that may raise unnecessary tension that pose a danger to the kenyan society.I hope the judiciary will take a very a swift and quick determination of the case so other politicians with similar habit of propagating hate can learn from the consequence of creating discord amongst communities and individuals through lies.

    I am shocked that the said midiwo is in south Africa on “parliamentary business”. His diplomatic passport should have been withdrawn until the veracity of his claims were verified.We cannot-AND I SAY THIS AS A REAL VICTIM OF POLITICAL VIOLENCE-allow leaders to get away with crimes that are only calculated for maximum chaos.Even if it turned out that he was right in his claim-the carelessness with which he uttered his statement is so dangerous that one wonders where in the world a “leader” would ever get away with that.Does he really care for the pm that he can be that casual?Does he care for the other Kenyans whose names he can so shamelessly slander?Does care for his own country that he can now purport to represent outside?The DPP has taken the best first step-thanks for heeding our cries-it is you and the CJ- courts that will give hope to a helpless nation.Do not allow another Kenyan to die for these politicians.

    Who can trust the police investigations and report? Give me a brake… what do kenyans expect from the CID or Police investigations? Where is the Athur Brothers report? Why did the very police give Ahur Brothers ranks in their force? Where is the investigation over false documents in parliament?       Kenyan police??? these are spanner boys who are used by the influencial individual to harass their fellow Kenyans while them themselves sleep in tents in the name of serving a Mheshmiwa. The Mheshimiwa’s children are abroad and these “school- drop out” police children are in a make-shift school? Shame on them.

    Midiwo should learn to play politics seperate from the national security. Hon Raila represents a national institution of a Prime Minister and a threat to the holder of that office is a threat to the nation. We know that you want Hon Raila, your cousin to be president next year but such tactics is alittle bit too far and even in strategic desperation  you are spoiling for Agwambo.  Let the DPP show you how to behave Hon Jakoyo and become example so that we may go to the next election in a more sorber manner

Anyhow, I have all along said that the downfall of RAO is a creation of his own.  By allowing the likes of Midiwo, Nyongo, orengo, and there is this other Jaluo who I cannot remember now, to lead his Dos and Donts.  Good, let Midiwo now go to court and defend his remarks.  There are a few things  I can assure RAILA right now.
    1.  Forget about the Kisii Vote.  You have allowed your sycophant to rap the kisiis the wrong way.
    2. You have shown that each time you are down, you want to create a situation to make the world believe in you.  Example. 2008 you declared “mass Action ” when you found out that you have lost the elections.  So the worls believed in you, people went to the streets to protest and in the process many people were killed.  In the end, you passed responsibility onto others. Ruto etc etc.

    I can foresee Raila bolting out of the coalition govnt, somewhere in Agust 2012.  Why, because he needs elections to be held this year.   Its is in him that what he says goes or the highway. 

    Let me ask everybody in here!   Has there been a time when Raila has been on the same side like all other politicians ?  Raila always wants to be on the other bank of the river.  If you cross the river to his side, he will cross over.   If Kibaki can saythat lets have elections this December or August as it is in the constitution, he will say NO.  He will cross over.

    All in all, stop crying wolf, even when there is no wolf around.

      Mimi try to argue your case with facts or else go back to school and learn literature. Am not supporting Raila but stop character assissination and reason issues. Raila is not as corrupt as you think no wonder he takes different paths. Pm Raila shed tears when he saw the pathetic situation when he toured one the refugee camp. When he authorised for action to metigate the suffering in the camp, powerful Central charaters overode him. That why he is liked and takes a different vector from your soulmates. He is clean like “pamba”, next time try to get details before saying” wo raila! wo raila! Soma kwa upana halafu ulete debate kwa meza tukusaidie!

    this investigation was fast….i wish the other cases were like that.PEV,goldenberg,baraza,the hate speech, and many many more. this one the police found evidence so fast and acted so fast. very wanting wanting…but am happy atleast he will be charged in court and hope the court will be made public so he can spill the beans and complicate the matter further…lets be honest.midiwo cant just say those words in public without confidential information. he is not stupid..hopefully.. the court hearing should be made public and let him shame the devil…let the battle begins

      Nonsense! He was actually drunk and disorderly. Killing PM of the Republic is treason pal. And Midiwo being a member of parliament knows all that. How then did he wait, even supposedly not telling the intetned victim, till a burial to “spill” his so called beans? Obviously, the fellow thought with Raila in tow, nothing could happen to him. Thats why they are turning around to attack DPP! Midiwo therefore is not going to “spill” any beans at all, because there are none. And in any case, lies based on vacuum cant take long to investigate. You just trail them to a point whereby no one can explain this or that fact that cant add up. You therefore need not to be surprised by the swiftness of investigation. Otherwise, you are going to expose your ignorance. However, I do know there alot of people primed to believe that police force is for certain people and not for the republic. I cant blame you as such. You must also understand that there are alot of plausible lies that dont amount to much and Midiwo’s claim is a case in point. However, what worries me to the core is that you seem to have alot of trust in your do-nothing leaders, forgetting that most of then are cons with wisdom above the normal conmen!

    This is a nice one Mr. DPP. These lies which are meant to keep the country on edge and help merchants of deceit to regain their balance, must be delt with immediately. That a whole member of parliament would wait for a funeral event to disclose this extremely serious security information, tells it all. Its even more intriguing when the pm pretends he was not in the know about these obvious cooked up lies. There is no way an Mp and moreso, a relative to the pm, would withhold such information. Whats clear is that they engineered the matter together to mislead the country and hopefully, resuscitate their dwidling political fortunes. Needless to say, this is something they have done before with alot of success. Only that times have changed. The once gullible populace is extremely aware and analytical of every issue. And the one source of information that was once preserve, at expense of other Kenyans, hardly exist anymore. Thus, the fanning of emotions for no apparent reason never sell at all. But funny habits are at times hard to die. PM and his group have really subjected Kenyans to unbelievable rampant lies. Every time they are cornered, they come up with all sorts of claims. Kenyans have had to lose alot of resources trying to follow through those empty self-serving dramas. Thats why I dare suggest this fellow be jailed without option of the fine. The pain and lose of resources for the country far outweigh his rights. It must also be noted that this is a deliberate serious crime that can easily plunge the country in to chaos. Precedence needs to be set for cons who attempt to instill fear and inflict unnecessary loses to the country.
