Gesami had appeared at the Kisumu Law Courts and entered a plea for two counts of missapropriating the Constituency Development Funds and he therefore questioned why the anti-corruption officers went to his house at midnight demanding to arrest him.
“It is a total disregard of the law and a contempt of court; they cannot come to arrest me yet I was in court over the same matter,” the legislator told journalists at his Karen home on Wednesday.
Displaying copies of the bonds he was granted by the Kisumu Chief Magistrate’s court, Gesami said he was surprised when more than ten officers from the EACC and the area police station arrived at his home and started banging the doors.
“There is no way I could open for them at all, they could take you and you will disappear. How could I have known the motive of people coming to my home at night? My wife showed them copies of the bond through the window but they totally ignored them and continued to camp here until this morning,” he added.
The Assistant Minister is now accusing the EACC of disregarding court orders and wants an apology.
“They should apologise to me, they have no excuse of raiding my home when I have a bond,” he said.
EACC Spokesman Nicholas Simani later told Capital News that they have since realised that the MP had been bonded by court.
“We have indeed confirmed that Dr Gesami was in court on Tuesday where he was granted two bonds, the matter is now in court and he will not be arrested,” Mr Simani said.
Gesami is accused of missapropriating CDF funds in his constituency but he strongly believes the investigations on him were politically motivated.
“This is politics, nothing else but since the matter is in court, the truth will finally come out,” he said.
