When the International Criminal Court summoned him on five counts related to the 2008 post election violence, he immediately called a press conference where he pledged his full cooperation with the court in pursuit of justice.
The government announced that it would meet his legal fees in The Hague process together with Postmaster General Maj Gen (Rtd) Mohamed Hussein Ali, arguing that they are accused based on actions they took as public officials.
Muthaura is facing serious pressure to resign from his public office, to allow the ICC process to proceed without any interruptions.
A career civil servant and diplomat, he was appointed to his current post in February 2003, soon after the Kibaki-led Narc regime dislodged KANU from power in the historic December 2002 General Election.
From March 14, 1996 to April 24, 2001 he was the Secretary General of the East African Community. Previously, he held several ambassadorial positions under President Daniel arap Moi.
The prosecutor has dragged Muthaura to The Hague on account of him being the chairman of the National Security Advisory Committee which Luis Moreno Ocampo alleges resolved to order the police to stand down as Mungiki youths attacked supporters of Raila Odinga in Naivasha and Nakuru.
Born in 1946 in Meru County, Muthaura holds a Bachelor of Arts (BA) degree in Economics and Political Science and a diploma in International Relations from the University of Nairobi.
He has had a long career in the Civil Service. Straight after leaving the University of Nairobi in 1972, he was appointed the District Commissioner for Mombasa, a position he held until 1973. He was then appointed an Assistant Secretary in the Ministry of Foreign Affairs.
He has also been Kenya’s Ambassador to Belgium, Luxemburg and European Community, Kenya’s Permanent Representative to the United Nations (UN), New York as well as Secretary General of the East African Community.
He has served as the PS in the Ministry of Transport and Communication, Ministry of Environment and Natural Resources and Provincial Administration and National Security in the Office of the President.
