Kibaki invites applicants for new law team

NAIROBI, Kenya, Oct 2 – President Mwai Kibaki has invited Kenyans to apply for positions to the Commission for the Implementation of the Constitution (CIC).

In a Gazette Notice dated November 1, the President pointed out that the chairman of the nine-member Commission must be a person who is qualified to hold the office of judge of the Supreme Court under the new Constitution.

The other commissioners must have a distinguished career of not less than five years and hold a degree in law, public administration, economics, human rights or government.

Apart from individual applications, an organisation or group of persons can propose the nomination of any qualified person. Those interested in the positions have two weeks to submit their applications to the Public Service Commission.

The Implementation Commission will oversee the legislation and administrative procedures required to implement the new law.

It will also co-ordinate with the Attorney-General and the Kenya Law Reform Commission in preparing the legislation to implement the Constitution.

Already, Parliament has established an oversight committee for the implementation of the Constitution.

The 27-member Constitutional Implementation Oversight Committee is chaired by Mandera Central MP Abdikadir Mohammed and deputised by nominated legislator Millie Odhiambo.

The new Constitution has mandated the CIC to oversee the full implementation of the various chapters while the Parliamentary committee will coordinate the legislative angle of the process.

The Commission shall report regularly to the oversight committee on progress in the enforcement of the Constitution and any impediments to its implementation.

Kenyans ushered in a new Constitution on August 27, following an overwhelming majority vote in favour of the new laws at a referendum on August 4.

The CIC shall have a five-year tenure which may be extended via resolution of the National Assembly.
