Lawyer in court over death threats

NAIROBI, Kenya, Jan 14 – A lawyer charged with issuing death threats to his former wife was on Thursday remanded in custody by a Nairobi court after he failed to appear in court on time to answer to the charge.
 
Lawyer Memba Muriuki had on Tuesday been ordered to appear before the Nairobi Chief Magistrate Gilbert Mutembei  but came in late after the court had already dealt with the case.

By that time, the prosecution has applied for his arrest.

The court also ordered that he forfeits the cash bail of Sh30, 000 which had been issued by the police.

He is likely to appear in court on Friday.

Mr Muriuki allegedly threatened to kill his former wife Jacqueline Achieng on December 13 last year.

He is also accused of sending phone text messages using threatening and abusive language to Ms Achieng.
 
In another case, a former Assistant Commissioner of Lands who illegally acquired a government house has been jailed for four years.

George Fred Onyango was jailed by Kibera Chief Magistrate Uniter Kidullah without the option of a fine.

Ms Kidullah further ordered the civil servant to pay Sh2.5 million which is twice the amount of the house he acquired, or serve a further one year in jail in default.

The property will also revert back to the Government, Ms Kidullah ordered.

Mr Onyango’s wife who had been charged alongside the civil servant was however acquitted.

The magistrate said that Mr Onyango deserved severe punishment for deliberately abusing his office to acquire public property.

According to the magistrate, Mr Onyango used his position as an assistant commissioner of lands to allocate himself the house then proceeded to enter into a sale agreement to dispose it.

He was paid part of the purchase price before the law caught up with him.

According to the evidence, a company owned by Mr Onyango and the wife, Gefrea Agencies had applied for allocation of the house in 1996.

The allocation letter was done by Mr Onyango.

Mr Onyango told the court in mitigation that he was a father of five children some of who are in university while others are in high school.

He pleaded for a non custodial sentence saying that he was suffering arthritis.
