Man jailed for defiling sister

NYAHURURU, Kenya, Feb 5 – A man has been sentenced to 15 years in prison for defiling his ten-year-old sister in March last year.

24-year-old David Ngige Njuguna was condemned to jail by the acting Senior Resident Magistrate Timothy Mwangi at a Nyahururu court, after being found guilty of defiling his young sister who was under his care at the time.

The accused was charged with committing the offence on March 10, 2007 at Muthengera village in Laikipia West district.

The court heard that on the said date, the accused was left at home by his mother and instructed to prepare supper as she went to the market. After supper, the siblings retired to their respective bedrooms, but the accused is said to have gone into his sister’s bedroom later that evening, forced her to undress while stuffing a bottle into her mouth to stifle screams as he raped her.

The Standard-Two girl informed her mother of the incident when she returned home and after a discussion with the village elders Ngige was taken to the area’s Administration Police camp.

Chief Inspector John Ruto urged the court to mete out a stern sentence, saying the incident had left the little girl traumatised for life.

The Magistrate noted that the prosecution had proved beyond reasonable doubt that the accused committed the heinous act to the minor, calling it a ‘beastly act and a betrayal of trust bestowed upon him by his mother’.

The court also observed that the accused did not dispute the evidence adduced by his sister, but only pleaded with the court for a lenient sentence.

The Magistrate declared Ngige as a dangerous man who should remain under constant surveillance even after his release.

Inspector Ruto also observed that cases of rape were rife within the jurisdiction of the court and urged the court to take notice of the same.
