ECK to declare Kamukunji poll winner

NAIROBI, August 7 – The Electoral Commission of Kenya (ECK) has announced that it will complete the tallying exercise of the Kamukunji vote at the Shauri Moyo Social Hall on Monday, and thereafter declare the winner.

The Commission’s Chairman Samuel Kivuitu said in a statement on Thursday that the exercise shall be held in compliance with a court order delivered on July 29, in a case filed by the Party of National Unity’s (PNU), Simon Ng’ang’a Mbugua.

Kivuitu was notifying the 2007 parliamentary and civic candidates alongside their voters and accredited observers, who participated in the elections, so that they could attend.

He said the electoral areas involved include Muthurwa/Shauri Moyo, Pumwani, Eastleigh North and South, Kimathi, Uhuru and the Air Base area.

“Parliamentary and civic candidates who contested the said elections are requested to attend the tallying in person or in case of unavailability, send an agent.”

Similarly, the ECK chair said, political parties which participated and were wishing to witness the tallying should be represented by a high-ranking official.

“The support of candidates, political parties and Kamukunji voters is essential in making this tallying process a success. I appeal for calm, tolerance and restraint during the tallying,” Kivuitu pleaded.

Prior to the cancellation of the elections that were marred by violence, results of 123 polling stations had been approved and signed by all the candidates’ agents.

Ng’ang’a, who is poised to win, judging from the tallied results, moved the court seeking to force the Returning Officer to announce him as the winner.

ECK cancelled the election after violence broke out during the tallying process, but the judges hearing the case ruled that the decision was unreasonable since the missing votes would not have changed the results. They ruled that the electoral body acted in excess of its powers.

The court at the onset issued interim orders barring fresh elections from being held as announced by the ECK.

The commission had wanted the election held together with those in four other constituencies whose poll results were nullified due to irregularities.

These included Wajir North, Embakasi, Ainamoi and Kilgoris.
