He also called for a voluntary structure of interconnecting so that the dominant player, in this case Safaricom allows the other players to grow.

“If we don’t make any profits, we can’t continue operating like the case Essar which had to leave, already Orange is struggling. Who says that we will not be in that situation in the next few years,” added Youssefi.

Information CS Fred Matiang’i has already drafted the Kenya Information and Communications (Fair Competition and Equality of Treatment) Regulations, 2015 which lower the criteria for determining a licensee as dominant.

The said regulations would effectively place Safaricom as dominant and thus subject it to more punitive reporting, costing and pricing.

A dominant licensee shall be required to adopt cost based charges for interconnection for all services including M-PESA as set out by the CA from time to time which is likely to be much lower than the interconnect fee set by the regulator thereby benefiting the smaller service providers.
