Justice Maureen Odero made the order on Friday after Ahmed’s lawyer moved to court to challenge the warrant, issued after National Bank allegedly failed to comply with a court order freezing the account of the Aviation and Airport Services Workers Union with the bank.
The freeze order was issued by Industrial Court judge Nduma Nderi on December 4 in a dispute pitting the Union trustees against the officials.
Justice Nderi ordered the NBK MD together with Bonne Barasa and Robert Lichuoro who are officials of the Aviation and Airport Services Workers’ Union be arrested by police officers at Kilimani for allowing the two officials to withdraw money from his bank despite the court issuing orders barring them from doing so.
The lawyers for the Union had last Tuesday sought to have Ahmed and the two Union officials, Bonne Barasa and Robert Lichuoro arrested and charged with contempt of court.
The Aviation and Airport Services Workers Union trustees had sued their officials for misappropriation of the Union’s funds and had successfully obtained two court orders barring the bank and the officials from making any transactions from the Union’s account.
Their lawyer Stephen Mogaka who described the contempt of court as a grave attack on court powers said that unless the four are forced to comply, they will continue to trample over authority of the court.
Justice Nderi on December 4 ordered that the Aviation and Airport Services Workers’ Union account at the National Bank of Kenya, Harambee Avenue branch be frozen.
This was in the presence of Barasa and Lichuoro who are the signatories to the said Union account.
The officials have allegedly continued to transact money from the account adding up to Sh3.8m on various dates between December 4 and December 16.
The case will be heard on January 16.
