NAIROBI, Kenya, Nov 8 – The Industrial Court has dismissed former National Social Security Fund (NSSF) Managing Trustee Tom Odongo’s application for reinstatement.

In his ruling Justice Nzioki wa Makau reasoned that by accepting Sh2.9 million from the fund following his dismissal, Odongo inadvertently signed-off on it and could not then turn around and claim it was unfounded.

On dismissing the case, Makau also ordered that Odongo shoulder the costs of the trial.

Odongo moved to court in July following his dismissal by the Cabinet Secretary for Labour Kazungu Kambi for unexplained reasons.

And it was on this ground that Odongo moved to court hoping to stop the recruitment of his replacement by the NSSF board and seeking to be reinstated.
